Terms of Service
Welcome to FireUp. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Apparent Group Limited (“Company,” “we,” “us,” or “our”), governing your access to and use of the FireUp mobile application and related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Description of Service
FireUp is a motivational application designed to provide users with audio content (“Power Talks”), quotes, and personalized success plans to encourage personal development, discipline, and motivation.

2. User Accounts
To access certain features of the Service, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Notify us immediately if you discover or suspect any security breaches related to the Service.
You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading.
3. Subscriptions and Billing
A. Subscription Plans
FireUp offers subscription plans that grant access to premium content and features. By selecting a subscription plan, you agree to pay the fees indicated for that plan.
B. Auto-Renewal
Your subscription will automatically renew at the end of each billing cycle (e.g., weekly, yearly) unless you cancel it before the renewal date. The payment method linked to your account (e.g., Apple ID, Google Play) will be charged automatically.
C. Cancellation
You may cancel your subscription at any time through your device’s account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to the Service until that time. We do not provide refunds for partial subscription periods.
D. Free Trials
We may offer free trials for a limited period. If you do not cancel before the trial period ends, you will be automatically enrolled in the paid subscription plan you selected.
4. Intellectual Property Rights
A. Company Content
All content available on the Service, including but not limited to text, graphics, logos, audio clips (“Power Talks”), software, and the compilation thereof, is the property of Apparent Group Limited or its licensors and is protected by copyright, trademark, and other intellectual property laws.
B. License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use.
C. Restrictions
You may not:
- Copy, modify, or create derivative works based on the Service or its content.
- Distribute, license, lease, sell, or otherwise transfer the Service to any third party.
- Reverse engineer, decompile, or disassemble the Service.
- Use the Service for any illegal or unauthorized purpose.
5. User Conduct
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law.
- Harass, abuse, or harm another person.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Attempt to gain unauthorized access to any portion of the Service.
6. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Apparent Group Limited, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; and
- Unauthorized access, use, or alteration of your transmissions or content.
Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us for the use of the Service in the twelve (12) months preceding the claim.
7. Indemnification
You agree to indemnify, defend, and hold harmless Apparent Group Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration in Hong Kong.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will indicate the date of the last update at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
